Kawarau Jet Services Holdings Ltd - RM150773

Land use consent is sought to operate commercial jet boat trips on Lake  Wakatipu (Queenstown Bay, the Narrows, and Frankton Arm); the Kawarau River between the outlet and Smiths Falls (just downstream of the Arrow River confluence); and the Shotover River between the confluence with the Kawarau River and Tucker Beach.

 

Kawarau Jet formerly held a total of nine resource consents for operations on Lake Wakatipu, and the Shotover and/or Kawarau Rivers. The Environment Court in [2015] NZEnvC 014 found that three of these nine consents had lapsed because they had not been given effect to since granting. This decision  was confirmed by the High Court in CIV- 2015-425-000024 [2015] NZHC 2343, dated 25 September 2015. The current application seeks to re-authorise the lapsed operations (previously held under resource consents referenced RM990399, RM990398, and RM040414(b)), and proposes one resource consent comprising the operations of the three lapsed consents.

 

The three lapsed consents had authorised:

  • A total of 4 boats, with capacity of 12, 18 or unlimited passengers each.
  • Three of the boats (two with 12 seats and one with 18 seats) were authorised to operate on Lake Wakatipu and the Kawarau River to Smiths Falls and to Tucker Beach.
  • One of the boats (of no specified maximum passenger capacity) was authorised to operate on Lake Wakatipu and the Shotover River to Tucker Beach).
  • A maximum of 12 trips per day per boat (approximately 1 trip per hour per boat but some trips may be shorter or longer than an hour).
  • Hours of operation were authorised between 8am – 8pm daily.

 

Kawarau Jet proposes that the conditions of the lapsed consents be consolidated into a single proposed set of conditions volunteered as part of this application, including that the capacity of each boat is 32 passengers.

The boats will be operated under Kawarau Jet’s established Safe Operations Plan, which is formally approved by Maritime New Zealand and which is integrated with the Safe Operations Plan of Queenstown Water Taxis Limited

which also is able to operate commercial jetboats on the subject stretches of the lake and rivers.

The application relates to the following areas:

(a) The surface of Lake Wakatipu including:

(i) Queenstown Bay (where the applicant’s existing wharf facilities at the Main Town Pier are located)

(ii) the Narrows;

(iii) Frankton Arm (where the applicant’s base facilities and workshops are located);

(b) The Kawarau River between the outlet (at the eastern end of Frankton Arm) and Smiths Falls (which is

downstream of the confluence of the Kawarau River and the Arrow River); and

(c) The Shotover River between the confluence with the Kawarau River and Tucker Beach.

All of the land the subject of the application is owned by the Crown.
