Resource consent objections
The Resource Management Act 1991 (RMA) provides a formal process for applicants to object to some Council decisions and invoices relating to resource consents.
-
You must lodge your objection within 15 working days of:
A resource consent decision being issued; or
The invoice being objected to being issued.
Objections received after this timeframe will not be considered.
-
Before lodging an objection, applicants are encouraged to discuss the matter with their planning consultant, agent, or seek independent legal or planning advice. Professional advice can help you understand the implications of the decision, conditions, or charges and determine whether an objection is the most appropriate course of action.
An objection must be lodged within the legal timeframes using the application form below.
-
If you lodge an objection to a resource consent decision, Council will recover the actual and reasonable costs incurred in considering and determining the objection. These costs will be charged to the applicant and invoiced following completion of the objection process.
The costs may include staff time, preparation of reports, engagement of specialist advisors, and the costs of any hearings required to determine the objection.
-
Once your objection has been received, Council will acknowledge and review it. Under the Resource Management Act 1991, Council is required to consider eligible objections lodged within the prescribed timeframe.
The steps Council takes will depend on the nature of the objection and the requirements of the Act. Following its review, Council will provide you with a formal response outlining the outcome of the objection process.
-
Council will provide a formal decision on your objection once it has been considered.
If you are not satisfied with the outcome, further rights or options may be available to you under the Resource Management Act 1991. These rights will depend on the nature of the objection and the circumstances of your case.
We recommend that you seek independent legal or planning advice to understand any further options that may be available to you.
